Terms of Use of Mobile Application

1. General Information

The Moominworld app (hereinafter “App”) is owned and provided by Muumimaailma Oy (hereinafter “Moominworld”), Business ID 0925595-8, address: Muumimaailma Oy, Kaivokatu 5, 21100 Naantali, Suomi Finland. Through the App the customer (hereinafter “Customer”) can access and purchase Moominworld products and services (“hereinafter “Products”) in accordance with these Terms of Use. These Terms of Use apply to the App and the material contained therein.  By using the App, the Customer accepts these Terms of Use and agrees to comply with them and with the instructions provided separately in the App. The Terms of Use are available for the Customer in the App. We recommend that the Customer saves or prints the Terms of Use for future reference. The Terms related to the App are available in Finnish and in English.

2. Moominworld App

The App is a mobile service offered by Moominworld to its customers. The App can be used either on a basic level without registration or alternatively as a registered user, a so-called Moominworld Family Friend (hereinafter “Family Friend”). The basic level, i.e. unregistered users. The downloading and use of the App do not require registration by the Customer. At the basic level, the Customer receives information on Moominworld products, locations, and services through the App. Unregistered users cannot place orders via the App or use the benefits offered by it. Family Friends, i.e. registered, logged-in users. To register in the App, one must become a Moominworld Family Friend. As a Family Friend, the Customer will have access to the benefits valid at the time and will be able to place orders and make purchases through the App. The App itself acts as an electronic loyalty card, which the Customer must present when shopping in Moominworld.  Family Friends can place orders through the App at designated Moominworld points of sale and pick up their orders at the time of their choosing. Through the App, the Customer can, among other things, receive information about current benefits and offers, information about the day’s programme, information about their own valid entrance tickets and other purchases, and access other available digital content. The full terms and conditions of the Moominworld Family Friend programme can be found on the Moominworld website at www.muumimaailma.fi. To ensure the proper functioning of the App, the Customer must make sure that they are using the latest version of it.

3. Product Range and Price List

The range of products shown in the App does not include all Moominworld products and is also limited according to Moominworld opening times. All prices shown include VAT and other applicable taxes and charges.

4. Ordering

4.1 Order

A Family Friend can place an order and pay for it in the App, in which case the order can be collected directly from a collection point at a selected point of sale. The order requires payment before collection. Orders are not available for all points of sale in Moominworld. The App will indicate the locations where an order is possible. The time of ordering is defined below as the time when the Customer confirms and pays for the order in the App. An order placed in the App is binding for the Customer. If an order requires preparation, the preparation will begin in the point of sale as soon as possible. The Customer will be able to use the App for tracking the preparation of the order and when it is ready for a collection. Information on the completed order will be delivered to the Customer as an App notification, provided that the Customer has enabled App notifications in the App settings. Orders that do not require preparation, such as games of chance, face painting, and other similar service products, are available as soon as the Customer has received an order confirmation in the App. Moominworld will endeavour to complete a customer’s order as soon as possible. The Customer understands that, during busy periods, it may take longer than anticipated to complete an order, and that the order is not necessarily immediately available for collection. The Customer is not entitled to compensation for late orders, unless otherwise provided in mandatory legislation.

4.2 Payment of an Advance Order

The Customer may pay for the order via a payment method offered by Nets A/S. The payment intermediary and payment service provider is Nets A/S. 4.3 Cancellation of an Order

The Customer has no right to cancel an order. In accordance with the applicable law, there is no right of withdrawal in distance selling for individual deliveries of food and other groceries.

4.4 Late Collection of an Order

Every effort will be made to prepare an order as soon as possible. The Customer will be able to use the App for tracking the preparation of the order and when it is ready for a collection. If the Customer has enabled App notifications in the App settings, they will receive an App notification when their order is ready for collection. The order will be held at the point of sale for 25 minutes from the time the order is available for collection, up until the time the point of sale closes. If the Customer does not collect their order during this time, the order will be destroyed. The Customer is not entitled to a refund for late collection. In order to ensure product safety, products cannot be released after the end of the collection period.

4.5 Product Reclamations

Complaints regarding Products should be made directly at a relevant point of sale or via the feedback section of the App. The Customer may invoke their legal remedies under the applicable law.

5. Intellectual Property Rights and Right to Use the App.

The App and its content, including but not limited to trademarks, trade names, product information and images, are the property of Moominworld and/or its partners and are protected by e.g. copyright law and international intellectual property rights treaties. All rights to the App and its content are reserved. Use of the App is permitted for personal, non-commercial use only. The material may be viewed, browsed, and stored on a terminal device, and parts of it may be printed for personal use. Any reproduction, other storage, lending, retransmission, or other use, even partial, of the material contained in the App is prohibited without the express prior written consent of Moominworld. The Customer shall not use the App in any way that is contrary to these Terms of Use, law, or good practice.

6. The Responsibility of Moominworld

The App and its content are provided to the Customer “as is”. Moominworld is not responsible for any errors, omissions, or other defects in the content provided in the App. Moominworld does not guarantee the availability of the App or its uninterrupted or error-free operation.  Moominworld is not liable for any costs, losses, or other damages that may arise from the use of this App or the information provided in the App, unless otherwise required by mandatory law.

7. Third Party Services

The App may contain links to websites owned or operated by third parties. Moominworld is not responsible for operation, content, or other features of such third party sites. When accessing these sites, the Customer must accept any terms and conditions of use of these sites before using them.

8. Processing of Personal Data

Moominworld processes and collects personal data of registered users in order to provide services and to maintain and develop customer relations. A more detailed privacy policy about Moominworld’s customer register can be found on Moominworld’s website at https://www.muumimaailma.fi/yritysinfo/tietosuojaseloste This is a brief description of the principles and practices related to the processing of personal data in relation to the App.

8.1. Data subject groups, data content and data groups in the register

Mobile Application The register contains the name and contact information of the users of the Moominworld mobile app connected to the unique identifier of their mobile device. The personal data are collected from the data subjects themselves and is based on the data subject’s consent. Some data are shared with Moominworld’s email marketing system and point-of-sale system. These types of data include:

  • Name
  • Email address
  • Phone number
  • Marketing consent
  • Order data
    • Ordered products and services
    • Order date

Other types of data collected:

  • Payment method details (Nets A/S)(optional)
  • Location data (optional)

Location data or payment method details will not be automatically transferred outside the mobile app’s management system. Location data will only be collected when the mobile app is used. Magic Bracelet system So-called RFID-based data are used when a customer registers an identifier with an RFID chip. These are used for activating features within the park. The features include different kinds of special effects, information boards, and other similar personalised content. When activating features, the following data are collected:

  • RFID identifier
  • Name
  • Date of birth
  • Town
  • Favourite character
  • Favourite colour

Personal data of non-registered users are not collected.

9. Other Conditions

Moominworld may modify, update, cancel, or remove the App, the content of the App or parts thereof at its discretion. This includes any additions to these Terms of Use. However, customers will be notified of material changes to the agreement within a reasonable time prior to the change, either via the App or by email to the email address provided by the Customer. The Customer must accept any changes to the Terms of Use in order to continue using the App. The Customer must use the App in accordance with the terms of use of the application store from which the Customer procured the App. The App will be available to the Customer without any separate login until the Customer deletes the App from their device. The Customer is responsible for the accuracy of the information provided, for the careful storage of their username and password, and for ensuring appropriate security of their phone/device. The Customer shall be responsible for all transactions in the App using their username. The use of the service, purchases made through the App, and these Terms of Use shall be governed by Finnish law.  However, if the Customer is based in an EU country, the mandatory consumer protection laws of that country take precedence over these rules. The parties shall endeavour to settle any disputes arising out of this agreement primarily by negotiation. If no amicable solution can be found, the dispute will be settled by the competent court in the place where the Customer is domiciled. The Customer may also bring the dispute before the competent court in the place where Moominworld is established. The Customer may also bring the dispute before the Consumer Disputes Board in their country of residence.
